Terms and Conditions

The Parties:

  1. AUTUMN TALES SRL [company legally incorporated in Romania, headquartered in Bucharest, Sector 2, Soseaua Pantelimon, nr.252, Bloc 55A, Scara A, etaj 2, Ap.7, Cam.1, Trade Registry no. J40/10077/2023, fiscal no. 48251260, EU VAT: RO4841729, bank account RON: RO96BTRLRONCRT0673621801, EUR: RO46BTRLEURCRT0673621801, e-mail contact@autumntales.ro] 
  2. Customer of the services, hereinafter referred to as the “Beneficiary”,

hereinafter collectively referred to as the “Parties” and individually referred to as the “Party”, convened to conclude the present Services Terms and Conditions (the „T&C”), under the following T&C and conditions.

Art. 1. Scope of the T&C

The scope of the T&C consists in delivery of services: “A Tale of Bucharest” Walking tours (the “Service”) as detailed by the Provider to the Beneficiary on current website (www.autumntales.ro ,  the “Website”).

 

Art. 2. Duration

2.1  The Duration of the Service is from the day of Booking of Service until the day the service is fully delivered.

2.2  Duration of Service is detailed on respective Service page.

Art 3. Bookings and cancellations

3.1. Any booking of service will be considered valid if service booked:

3.2. Any booking sent via any other ways of communication will be considered invalid

3.3. Cut-off time of bookings depends of method of booking:

  • by e-mail: 24 hours before service start time
  • by Provider website: 4 hours before service start time

3.4. Booking confirmations will be sent:

  • booking by e-mail: max. 12 hours from booking receipt
  • booking by Provider website: instant confirmation

3.5. Beneficiary may cancel booking up to 24 hours before service start date and receive a full refund.

3.6. Any cancellation less than 24 hours before service start date will not be eligible for a refund.

3.7. Provider may cancel booking up to 24 hours before service start date and offer Beneficiary a full refund.

3.8. Provider may cancel the booking in less than 24 hours before tour start date in case of bad weather. Beneficiary will be offered a different time for service or a full refund.

3.9. Start time of service is in the local timezone.

 

Art 4. Price

 

4.1. The price of the Services are detailed on the respective Service website pages.

4.2. The price will only include the delivery of services by the Provider in the interest of the Beneficiary, with no additional costs such as but not limited to: travel costs, meals, entrance fees or other personal expenses of Beneficiary.

4.3. Provider will issue invoices for all services to the Beneficiary based on the date of Booking of Service.

4.4. Base currency of the Service will be displayed in local currency, namely Romanian Leu (RON).

4.5. In case booking will be placed on agreed distribution channels in any other currency than RON, respective distribution channels may apply own exchange rate from the day of the booking. Beneficiary will consult distribution channel own Terms and Conditions.

4.6. All service invoices will be issued and paid in local currency RON.

4.7. Non-residents may have the option to have the invoice issued and paid in Euro currency (EUR) at an exchange rate of 1 EUR = 5 RON, only with prior notice before booking the service.

4.8. Any Beneficiary bank and/or card fees, commissions or foreign exchange differences will be supported by Beneficiary.

4.9. The price will be paid on the day of the transmission of the invoice by the Provider to the Beneficiary via e-mail according to the banking data in the preamble.

4.10. In case of payment of invoice not done with at least 4 hours before the start time of Service, Provider reserves the right of cancelling the Booking.

4.11. Tours organized under “pay-what-you-wish” price:

  • All payments for “pay-what-you-wish” tours are voluntary and participation at the tour is not restricted by any payment or lack of payment;
  • Beneficiary will choose the amount to be paid based on the tour experience and satisfaction;
  • Provider shall inform at the start of the tour that the tour is a “pay what you like” tour;
  • Provider will reserve the right to recommend an amount, the amount not being mandatory however;
  • In case of payments, Provider will inform participants of the payment methods and provide payment links via Stripe, Paypal, Revolut and/or bank account.

 

Art. 5 Rights and obligations

5.1. The Provider:

  • will deliver their Service professionally, offering all the necessary attention to the Beneficiary’s requests at the agreed T&C on website;
  • in case part or entire Service mentioned on website cannot be provided, Provider will present the Beneficiary with the best and most convenient alternatives without any additional cost. In case Beneficiary does not accept the alternative, Provider will reimburse the cost of the Service within 5 working days;
  • cannot sub-T&C the Service to another provider without the express written agreement of the other Party;
  • will maintain confidentiality of all data and information from the T&C throughout its duration, as well as after the termination of the T&C;
  • will provide to Beneficiary an invoice for the services provided;
  • does not hold any responsibility for any of Beneficiary’s or other participant personal belongings;
  • does not hold any responsibility for any injuries of Beneficiary and/or members of Beneficiary’s group caused by Beneficiary’s and/or member of group own fault ( examples include but not limit to: tripping, falling etc.) or from ignoring guide’s instructions;
  • will reserve the right to refuse the admission or continuation of the tour of any person that shows under visible influence of alcohol, drugs or who doesn’t follow the guide’s instructions, without any possibility of reimbursement.

5.2. The Beneficiary:

  • will pay the price for the Services, in the T&C and conditions provided by the T&C.
  • will be present at the location and time mentioned on website. If Beneficiary will be late more than 15 minutes without notice, Beneficiary will be considered no-show and tour price will not be reimbursed.
  • has the right to request any personalization of the tour with prior written notice to Provider and only if Provider confirms the request in writing.
  • is responsible for the conduct of all the persons for which the booking has been made by Beneficiary;
  • is responsible for own and other persons for which the booking has been made by Beneficiary personal belongings during the tour;
  • is not allowed to present at the tour under influence of alcohol or drugs or to consume any alcohol or other forbidden substances during the tour;
  • will respect all the guide’s instructions during the tour.

 

Art. 6 Notices

6.1 All notices or requests between the Parties shall be made only in writing and submitted by e-mail to the Parties according to the following contact details:

6.2 Any change to the above data shall be notified to the other Party. Otherwise, any communication to the above addresses will be considered valid.

6.3. Communication will be made during normal working hours, 9.00-17.00. Any communication made outside this period shall be deemed to have been received the next day, during working hours.

6.4. Any communication made without complying with the above provisions, including but not limited to: Telephone conversation, SMS messages, WhatsApp, Messenger, shall not be considered to be valid between the parties.

Art. 7 Protection of personal data – GDPR

7.1. If during the performance of the T&C process personal data as defined by Regulation EU 2016/679 and any other legislation in force concerning employees, T&Cing parties, business partners or any other natural person in relation to the other Party (hereinafter referred to as „Personal data”), the Parties agree and guarantee the following:

  • to comply with the law and legal rules applicable to its services with regard to the protection of privacy and personal data
  • process personal data only to the extent that it is necessary and if allowed/required by law
  •     to maintain the confidentiality of personal data
  • take appropriate technical, physical and organizational security measures to protect personal data against loss, unauthorized or unlawful processing
  • promptly inform the competent authorities and the T&Cing party of any security incident that exists or is suspected to occur, involving personal data

 

7.2. Privacy Policy related to the present T&C is attached in Annex 2.

 

 

 

  1. Force Majeure

 

8.1. Force majeure should be ascertained by a competent authority and relieves the Parties of fulfilling their obligations undertaken hereunder, throughout its duration.

8.2 The Party claiming force majeure is required to notify the other Party within 5 days from the occurrence of the said event and to take all available measures in order to limit the consequences.

8.3 If the force majeure event takes place or is estimated to take place during the performance of Service, either Party can notify rightful termination of the T&C to the other Party and neither of the Parties will have the right to request damages from the other Party.

 

Art. 9 Amendments and termination

9.1 The T&C may be amended by Provider and revisions will be sent to Beneficiary

9.2 Any amendment of this T&C will have effect only on bookings done after the T&C revision.

Art. 10 Applicable law and litigation

10.1 The T&C is governed by Romanian law.

10.2 Any dispute related to the T&C will be solved by amiable negotiations and, if negotiations fail, by the competent Romanian courts of law in Bucharest District 2.

10.3 The T&C will be concluded by remote signing via e-mail or by accepting the Terms and Conditions during booking process.
